2. License

By downloading or using Derivate ("the App"), you agree to these Terms of Service. The App is licensed, not sold, to you for use strictly in accordance with these terms.

• You may use the App on any Apple device that you own or control, as permitted by the App Store Terms of Service.
• You may not distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time.
• You may not reverse engineer, decompile, or disassemble the App.

3. Financial Instruments & Risks

Derivate is a calculator tool for warrants and options. It is essential that you understand the following:

• Warrants are leveraged products. Small changes in the underlying asset can lead to disproportionately large gains or losses.
• Total loss is possible. Warrants can expire worthless, resulting in a 100% loss of your invested capital.
• Time decay (Theta). Warrants lose value over time, even if the underlying asset price remains unchanged.
• Implied volatility risk. Changes in market volatility can significantly affect warrant prices independently of the underlying asset.
• This app does not provide investment advice. All calculations are mathematical models and should not be the sole basis for investment decisions.

4. Calculations & Models Disclaimer

The App uses the Black-Scholes model and related mathematical formulas. You acknowledge that:

• The Black-Scholes model is a theoretical pricing model with known limitations and assumptions (e.g., constant volatility, no dividends, European-style exercise).
• Calculated prices may differ significantly from actual market prices due to market conditions, liquidity, bid-ask spreads, and issuer-specific factors.
• Greeks (Delta, Gamma, Theta, Vega) are theoretical estimates and may not accurately reflect real-world behavior.
• Scenario matrix results are hypothetical projections and not predictions of future outcomes.
• The App makes no guarantee of accuracy, completeness, or timeliness of any calculations.

5. Liability Disclaimer

The App is provided "as is" without warranty of any kind, either expressed or implied. To the fullest extent permitted by applicable law:

• We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any financial losses, damages, or costs arising from the use of or reliance on the App or its calculations.
• We are not responsible for investment decisions made based on the App's output.
• We are not liable for any errors, inaccuracies, or omissions in calculations.

6. Intellectual Property

All intellectual property rights in the App, including but not limited to the design, code, graphics, and user interface, are owned by Daricate Developments. You may not copy, modify, or create derivative works based on the App.

7. Technical Requirements

The App requires:

• An iOS device running a compatible version of iOS
• Sufficient storage space on your device
• Internet connection is not required for core functionality (only for optional exchange rate fetching)

8. Updates

We may release updates to the App from time to time. These updates may include bug fixes, new features, or changes to existing functionality. We recommend keeping the App up to date to ensure the best experience.

9. Termination

These terms are effective until terminated. Your rights under these terms will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete all copies from your devices.

10. Applicable Law

These terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Germany.
